Regulation (EU) 2018/1862 constitutes the legal basis for the Schengen Information System (SIS) when it comes to conditions and procedures for the entry and processing of alerts on persons and objects and for the exchange of supplementary information and data for the purpose of police and judicial cooperation in criminal matters.

Given the global nature of serious crime and terrorism, the information that third countries and international organisations obtain about perpetrators and suspects has become increasingly relevant for the EU's internal security. Some of that information, in particular where the person concerned is a third-country national, has only been shared only with Europol. In order to bridge that gap, it became necessary to ensure that, upon a proposal by Europol, Member States are able to enter information alerts into SIS on third-country nationals in the interest of the EU, in order to make that information provided by third countries and international organisations available, directly and in real time, to front-line officers in Member States.

This Regulation covers the establishment and regulation of a specific category of alerts entered into SIS by Member States upon a proposal by Europol in the interest of the EU in order to exchange information on persons involved in serious crime or in terrorism. The draft law was put forward by the European Commission on 9 December 2020, alongside its latest Counter-Terrorism Agenda and connected with another legislative initiative on strengthening Europol's mandate. The Council of the European Union adopted its general approach on 13 October 2021, followed by the plenary of the European Parliament on 21 October. An informal agreement between the co-legislators on a compromise text for this file was reached on 1 February 2022. This was formally endorsed by the Parliament on 8 June and by the Council on 27 June. The Act was signed by the co-legislators on 6 July 2022 and published in the Official Journal on 12 July 2022.
