Summary: Communication presented by the European Commission on 18 March 2022, setting out operational guidelines aimed supporting Member States of the European Union (EU) in applying the Temporary Protection Directive. Further information: Council Directive 2001/55/EC - also known as the Temporary Protection Directive - sets up a scheme to deal with mass arrivals in the European Union (EU) of foreign national who cannot return to their countries, in particular due to war, violence or human rights violations. It puts in place immediate temporary protection for these displaced people. As a consequence of Russia's military invasion of Ukraine in February 2022, the Council of the European Union adopted on 4 March an Implementing Decision activating Directive 2001/55/EC for the first time ever. It therefore established the existence of a mass influx of displaced persons from Ukraine within the meaning of its Article 5. This Communication aims at providing comprehensive guidance for those arriving to have a consistent and effective level of rights, and for EU Member States to assume their new responsibilities. It is meant as a living document to reflect the situation on the ground and take due consideration of the evolving needs of the Member States. These guidelines also complement existing Guidelines for external border management published on 2 March 2022. |
