Summary:Legislative initiative tabled by the European Commission on 23 September 2020, setting out a Regulation concerning asylum and migration management. It is also known as the draft AMMR. It seeks to amend Council Directive (EC) 2003/109 and the Regulation (EU) 2021/1147. Further information:The draft law puts in place a common framework for asylum and migration management across the European Union (EU), as part of a comprehensive approach based on the promotion of mutual trust between Member States. It seeks to replace the existing Dublin Regulation and it relaunches the reform of the Common European Asylum System (CEAS). It provides for a new solidarity mechanism that aims at being flexible and responsive in design in order to be adjustable to the different situations presented by the different migratory challenges faced by the Member States, by setting solidarity measures from among which Member States can choose to contribute. It also includes provisions to strengthen the return of irregular migrants. The solidarity measures also comprise possibilities for Member States to provide assistance to each other in carrying out returns, in the form of return sponsorship. The fresh approach to migration management also includes improving the rules on responsibility for examining an application for international protection. This proposal further establishes a governance framework built on national strategies of the Member States, which will feed into a European Strategy on Asylum and Migration Management. This proposed Regulation was adopted by the European Commission on 23 September 2020 as part of the New Pact on Migration and Asylum. The plenary of the European Parliament endorsed a negotiating position on 20 April 2023. The Council of the European Union adopted its general approach on 8 June. |
