Introduction: "On April 2, 2008 the European Commission (Commission) published a White Paper on damage actions for breach of Articles 81 and 82 EC (White Paper), putting forward “a set of recommendations to ensure that victims of competition law infringements have access to truly effective mechanisms for claiming full compensation for the harm they have suffered”."
"The purpose of this article is not to add to the already large amount of literature analysing the specific recommendations in the White Paper (or the options discussed in the years preceding the White Paper) with respect to their correctness and plausible efficacy. Instead, its goal is to answer a simple, yet fundamental question: is there a need to enhance private enforcement of Articles 81 and 82 EC and, if so, does the White Paper comprehensively address that need?"
