Introduction: "On 2 April 2008 the European Commission published the White Paper on “Damages Actions for Breach of the EC Antitrust Rules”, building upon the public consultation that followed the Green Paper of 19 December 2005 with the same title. In the White Paper, the Commission declares its satisfaction for the success of the Green Paper with regard to the raising of “awareness of the victims’ right to compensation, and of the obstacles faced by victims of competition law infringements when attempting to enforce their rights” and reaffirms its commitment to the creation of “an effective private enforcement system in Europe”."
"This article aims to define the scope of application of the proposed EU-wide binding effect rule as it is presented in the White Paper and to discuss some of the issues expected to arise following its adoption by national legislators, whether on a voluntary basis or, most probably, following the eventual relevant provision in the forthcoming EC Draft Directive for Antitrust Damages."
