Summary: Regulation (EU) 2019/498 - adopted by the European Union's co-legislators on 25 March 2019 - aiming to help mitigate the significant impact that a no-deal Brexit would have on EU fisheries. Further information: Regulation (EU) 2017/2403 sets out the rules for fishing operations carried out by Union fishing vessels in waters of a third country and for third country vessels in Union waters. For fishing operations carried out by Union fishing vessels in waters of a third country, the Regulation provides that a flag Member State may grant direct authorisations to the operator and establishes the conditions and procedures for the granting of such authorisations. The United Kingdom (UK) submitted in 2017 the notification of its intention to withdraw from the European Union (EU). If a Withdrawal Agreement is not ratified, this means that the EU's primary and secondary law ceases to apply to the UK from 30 March 2019 [since extended to 12 April]. Given the number of EU fishing vessels that carry out fishing activities in waters of the United Kingdom, these conditions and procedures could lead to considerable delays and an increased administrative burden in the event of the UK leaving the EU without a withdrawal agreement. In November 2018, the European Commission presented a Contingency Action Plan in November 2018 setting out the measures it plans to take if no withdrawal agreement enters into force on the withdrawal date. The proposal for this Regulation was tabled by the Commission on 23 January 2019. The plenary of the European Parliament endorsed it on 19 March, followed by the Council of the European Union on the same day. The co-legislators signed the Act on 25 March, which was published in the Official Journal on 27 March 2019. |
