Means of Interaction between EU and International Law: ‘Good Fences Make Good Neighbors’ and Beyond … Two Faces of the Good Neighbourliness Principle

Summary:

This article discusses the relationship between EU Law and International Law. The article first clarifies the legal framework of good neighbourliness in international law, that is, its legal basis and the corresponding rights and duties of states in international law. Then in the second part, it analyses good neighbourliness within the EU context. The starting point of such analysis is the acknowledgement of the new legal order of the Union, which exists autonomously from international law, but is bound by an obligation to adhere strictly to the latter’s norms and principles, and, as expressly mentioned, the UN Charter.
