Summary: Regulation of the European Parliament and of the Council of 20 June 2019 on the marketing and use of explosives precursors, amending Annex XVII to Regulation (EC) No 1907/2006 and repealing Regulation (EU) No 98/2013. Further information: Explosives precursors are chemical substances that can be used for legitimate purposes but also misused to manufacture explosives. With a view to prevent the illicit manufacture of explosives, Regulation (EU) No 98/2013 restricts the making available, introduction, possession and use of selected explosives precursors to the general public and sets up rules on the reporting of suspicious transactions. While the amount of explosives precursors available on the market for public consumption has decreased since the Regulation was adopted, they continue to be used for the illicit manufacture of explosives and have been used in the vast majority of terrorist attacks in the European Union (EU) since then. The existing restrictions and controls have proved to be insufficient to prevent the illicit manufacture of homemade explosives. Furthermore, the Regulation lacks provisions that facilitate compliance and enforcement. As a part of the REFIT Programme, the revision of the Regulation aims to address problems by strengthening and clarifying it. The proposal was adopted by the European Commission on 17 April 2018. Member States' ambassadors adopted a general approach on 12 December, while the European Parliament's relevant committee adopted a mandate for trilogue negotiations on 10 January 2019. Following two rounds of negotiations, an informal agreement between co-legislators was reached on 4 February. The Parliament's plenary session formally endorsed the compromise text on 16 April. |
