Summary: The European Commission published on 10 April 2013 a proposal to modernise the European Union's basic anti-dumping (AD) and anti-subsidy regulations (AS). The European Parliament adopted its position on this proposal in April 2014. Discussions in the Council of the European Union stalled for over three years, until a common position was eventually approved in December 2016. The European Parliament's international trade committee voted for the opening of trilogue negotiations in February 2017. This interinstitutional agreement was reached following the eight round of talks, in December 2017. The Council formally endorsed this proposal in April 2018, followed by the Parliament on 30 May. Further information: The reform was intended to enhance the transparency and predictability of investigations, increase the effectiveness and enforcement of AD/AS measures and tackle the risk of retaliation. A key element of the proposal was the waiver of the 'lesser duty rule' (LDR) in cases of circumvention, subsidisation and structural raw-material distortions in exporting countries. + [COM(2013)191] Communication on modernisation of trade defence instruments.
