Abstract:

This contribution presents the case-law of the Austrian Constitutional Court in the aftermath of its landmark decision VfSlg 19.632/20121 where the Court held that certain rights of the Charter of Fundamental Rights of the European Union could be applied as constitutionally guaranteed rights under Article 144 of the Federal Constitution or as a standard of review in general judicial review proceedings. It aims at demonstrating the precariousness provoked by the said decision with regard to the application of Union law.
