On 27 April 2017, the European Commission initiated an infringement procedure against Austria concerning the application of the 'Austrian Act to Combat Wage and Social Dumping'(in German - Lohn- und Sozialdumping-Bekämpfungsgesetz) to the road transport sector. The Commission believes that this practice restricts the EU internal market disproportionately. As guardian of the Treaties, the Commission must ensure that the application of national measures is fully compatible with EU law, in particular the Posting of Workers Directive (Directive 96/71/EC), the transport acquis, the freedoms guaranteed by the Treaties, notably the freedom to provide services and the free movement of goods, and the principle of proportionality. |
