Summary:Report adopted by the European Commission on 26 August 2016, concerning the implementation of Directive 2008/52/EC on certain aspects of mediation in civil and commercial matters, including the area of family law. Further information:Directive 2008/52/EC seeks to facilitate access to alternative dispute resolution (ADR) and to promote the amicable settlement of disputes, by encouraging the use of mediation and by ensuring a sound relationship between mediation and judicial proceedings. It applies in cross-border disputes to civil and commercial matters and had to be transposed into national law by 21 May 2011. The assessment on the application of this Directive is carried out by this report in accordance with Article 11 of the Directive. It was published by the European Commission on 26 August 2016. |
