Aviation: Commission refers Croatia to the Court of Justice for failing to ratify EU accession to Eurocontrol international convention

ON the 17 November 2016, the European Commission has decided to refer Croatia to the Court of Justice of the EU for the non-ratification and non-deposition of the Protocol of Accession of the European Community to the Eurocontrol International Convention, signed in 2002.

The Commission considered that, having still not proceeded with the ratification, Croatia failed to fulfil its obligations under Article 4(3) of the Treaty on European Union (TEU). This Article lays down the principle of sincere cooperation and underlines the obligation of the Member States to facilitate the achievement of the Union's tasks and to refrain from any measure that could jeopardise the attainment of the Union's objectives.
