This proposal concerns the application of Council Regulation (EC) No 597/2009 of 11 June 2009 on protection against subsidised imports from countries not members of the European Community ('the basic Regulation') in the expiry review of the countervailing duty in force on imports of certain polyethylene terephthalate originating in India. This proposal is made in the context of the implementation of the basic Regulation and is the result of an investigation which was carried out in line with the substantive and procedural requirements laid out in the basic Regulation. On 24 February 2012, the Commission announced the initiation of an expiry review of the countervailing measures applicable to imports of certain polyethylene terephthalate originating in India. The review was initiated following a request lodged by the Committee of Polyethylene Terephthalate Manufacturers in Europe (CPME) on behalf of Union producers representing nearly 95% of the Union production of PET. The review investigation found continued subsidisation of the product concerned which would result in the recurrence of injury to the Union industry in case countervailing measures were lifted. It was further established that the continuation of measures was not against the interest of the Union. Therefore it is suggested that the Council adopts the attached proposal for a Regulation in order to extend the existing measures. |
