A Common European Asylum System has been put in place, composed of various instruments, following a transitional stage of communitarisation, for which the so-called Procedural Directive, adopted on Dec 1, 2005, was a final key element. Moderate progress and some truly regressive steps, these are the two trends that predominate in the Directive defining international protection on grounds of asylum in the European Union; and which reveal the increased weight of imperative issues other than that of protection. The primacy of the principle of protection must be restated, in particular in the judicial proceedings on the compatibility of the new Community provisions with the law of the Geneva Convention which are starting to take place -- admittedly, not without difficulty because of the limits on the competences recognised for the Court of Justice in this matter, despite the fact that it has been communitarised.
