The European Court of Justice has accepted that the necessity to protect the fundamental rights of individuals can justify the restriction of a fundamental freedom. The Omega case is another example of a fundamental right prevailing over one of the fundamental freedoms. The impact of this defence for restrictive State measures has not yet been fully explored.
