The Partnership and Cooperation Agreement establishing a partnership between the European Communities and their Member States, of the one part, and the Russian Federation, of the other part was signed on 24 June 1994. The Agreement entered into force on 1 December 1997.

According to the Act of Accession of the Republic of Croatia, the Republic of Croatia is to accede to international agreements signed or concluded by the European Union and its Member States by means of a protocol to those agreements.

A Council Decision of 14 September 2012 authorised the Commission to open negotiations with the third countries concerned, in order to conclude the relevant protocols. The negotiations with the Russian Federation were successfully concluded. The Russian Federation agreed to the Protocol text in its Note Verbale of 4 September, the EEAS in its Note Verbale of 24 September. This exchange of Notes Verbales, requested by the Russian Federation, replaced the initialling of the Protocol.

The Partnership and Cooperation Agreement with the Russian Federation in particular aims to promote trade and investment, including trade in transport services, and establishes a framework for cooperation in different sectors which is limited to an overall economic, financial and technical cooperation. Therefore, next to the applicable procedural legal bases, the Protocol should be signed and concluded by the European Union on the basis of Article 6(2) of the Act of Accession of the Republic of Croatia on the one hand and of Articles 91, 100(2), 207 and 212 TFEU of the other hand.

The Commission has judged the results of the negotiations to be satisfactory and requests the Council to recommend a Council Decision approving the conclusion, by the European Commission, on behalf of the European Atomic Energy Community, of the Protocol to the Partnership and Cooperation Agreement establishing a partnership between the European Communities and their Member States, of the one part, and the Russian Federation, of the other part, to take account of the accession of the Republic of Croatia to the European Union.
