The European Commission, in January 2012, proposed a new legislative framework for data protection. The framework consists of two documents: a draft Regulation legislating for general data protection across the EU and a draft Directive with the specific aim of protecting personal data processed for the purposes of prevention, detection, investigation or prosecution of criminal offences and related judicial activities. The draft Regulation would repeal and replace the 1995 Directive. The draft Directive would repeal and replace the existing Data Protection Framework Decision of 2008. This Standard Notes provides background information on the proposals, together with the response from the UK Goverment and Parliament and the reaction from other organisations. |
