For a long time, the proposition of a Constitution for Europe seemed inadequate given the structural peculiarities of the communitarian system that difficult the conclusion on the debate about its architecture, whether from a normative hierarchy point of view (which is not clearly configured, except for the Treaties and regulations), as well as the vertical division (the separation of competences) and horizontal (the separation of power among the States and the communitarian institutions). The biggest problem for a genuine Constitution is that, after all, even with much of a network of multilevel governments, the “competence of the competences” still remains on the States and is precisely its basic protagonist that makes EU a “sui generis” entity. |
