Abstract:

In 2008, the Council of the European Union adopted a reform of the common organisation of the market in wine aimed at improving the competitiveness of EU wine producers and balancing supply and demand. The financially most important components of the reform were two aid schemes, one for the grubbing-up of vineyards and the other for the restructuring and varietal conversion of vineyards.

The Court found that the grubbing-up was not sufficient to correct the existing market imbalance. The Court also found that the restructuring and conversion measure improved the competitiveness of vineyards, but in a number of cases also led to an increase in wine production for which new market outlets have to be secured.
