The European Commission adopted on 21 March 2012 a proposal to improve the way the Posted Workers Directive (96/71/EC), adopted in 1996, is applied in practice, without changing its provisions.

Simultaneously, the Commission also put forward a regulation taking on board existing case law regarding the working conditions of the posted workers the extent to which collective action and protection of workers could be extended to cross-border situations. It aimed to send a message that workers' rights and their freedom to strike are on an equal footing with the freedom to provide services.
