Summary: Regulation (EU) No 1053/2013 - formally adopted by the Council of the European Union on 7 October 2013 - establishing an evaluation and monitoring mechanism aimed to verify the application of the Schengen acquis by the Member States. Further information: This Regulation establishes a framework for a specific mechanism design to verify the application of the European Union's Schengen legislation. It aims to ensure that high uniform standards are applied in practice by those EU Member States in the Schengen area. This Act repeals a 1998 Decision setting up a Standing Committee on the evaluation and implementation of Schengen. The mechanism covers all aspects of the legislation in this field. As regards borders, it aims to cover both efficiency of border controls at external borders and absence of internal border controls. Member States and European Commission assume joint responsibility for the implementation of the mechanism. The draft law for this Regulation was tabled by the European Commission on 16 November 2010. A previous legislative initiative concerning revised mechanism for Schengen evaluation was withdrawn, but related discussions were taken into account in drafting the subsequent proposal. An amended proposal was unveiled on 16 September 2011 to address concerns from the European Council (June 2011) on the response to truly critical situations where a Member State is no longer able to comply with its obligations. This included a safeguard clause allowing for the reintroduction of borders. The proposal was published as part of a so-called Schengen Governance package. The Council of the European Union adopted its general approach in June 2012, triggering an adverse reaction from the European Parliament due to changes to the legal basis of the initiative. An informal agreement between the co-legislators on a compromise text for this draft law was eventually reached on 29 May 2013. The European Parliament formally endorsed it in a Resolution adopted on 12 June, followed by the Council of the European Union on 7 October 2013. The Act was formally signed on the same day and published in the Official Journal on 6 November 2013. |
