This briefing first explains the international human rights law framework relevant to provocation to terrorism and related offences, particularly public provocation, with a focus on freedom of expression. It then makes reference to relevant international case law and policy and highlights legislation and cases in selected EU Member States. It then gives a brief analysis of the human rights implications of the Commission proposal for a Council Framework Decision amending Framework Decision 2002/475/JHA on combating terrorism.
