Dilemmas in the implementation of Directive 2004/38 on the right of citizens and their family members to move and reside freely in the EU

This Briefing Note assesses the most relevant deficits in the transposition of Directive 2004/38/EC, in light of the answers and data provided by the National Parliaments of 11 EU Member States (Austria, Belgium, Cyprus, Czech Republic, Italy, Lithuania, Poland, Romania, Slovak Republic, Slovenia and Spain) to the questionnaire prepared by the Committee on Civil Liberties and Justice and Home Affairs (LIBE) of the European Parliament.
