Memo: Financial Penalties for Member States who fail to comply with Judgments of the European Court of Justice: European Commission clarifies rules

The European Commission on 14 December 2005 adopted a Communication to clarify and develop the policy of the Commission in asking the European Court of Justice (ECJ) to impose a periodic penalty payment and a lump sum on a Member State which fails to comply with a judgment of the ECJ. This clarification was required after the ruling of the ECJ on 12 July 2005 in Case C-304/02, Commission v French Republic.
