Legal bases of budget lines. Following the European Court of Justice's ruling of 12.5.98 in Case C-106/96 the European Commission has taken stock of the verification of budget lines without legal basis. By July 1998 the Commission had been able to totally or partly unblock 75 budget lines out of 100 temporarily suspended. For sixteen of the rest a proposal for a legal basis is pending with the Council and the European Parliament. Under current circumstances, the remainder cannot be implemented in conformity with the Court ruling. However, the Commission will respect the legitimate expectations which have already been created for their implementation in 1998. The Commission is also asking the Council and European Parliament to agree a long-term solution to the problem of legal bases.

On the 29.7.98 it was announced that a total of 83 budget lines had been totally or partially unblocked. A draft inter-institutional agreement between the Council, Commission and European Parliament, which brings a long-term solution to the problem of legal bases, was reached on 17.7.98.
