Abstract:

This manual looks at the core topics in EC competition law from the practitioner's perspective. It is organised over nine chapters and supported by comprehensive Appendices and Tables.

Chapter one presents a background to the subject matter with some important clarification of terms used frequently in the book. Chapter two addresses Article 81(1) - anti-competitive agreements. Article 81(3) is the subject of chapter three which explains the route to redemption of agreements falling foul of Article 81(1). Chapter four turns to Article 82 - the abuse of a dominant position - and the remedies for treating with the abuse of market dominance. Chapter five considers various aspects of compliance and the protections which may be availed. The procedural rules for investigations by the European Commission, found in Council Regulation 1/2003, are the focus of chapter six. The role played by EC law in national courts and its supremacy over national law are covered in chapter seven. Cases involving the competition rules in the European Court are examined in chapter eight. The final chapter examines the relationship between the competition rules, rules on free movement of goods and intellectual property rights.

The work will interest anyone required to understand, advise on, or apply EC competition law in practice, but more specifically those students taking the Bar Vocational Course.
