Abstract: Substantial harmonisation has been achieved in the European Union in the field of intellectual property law and, in particular, trade mark law. Nevertheless, difficulties have arisen, and ambiguities and lacunae have surfaced, and these have fallen to be resolved by the Community Courts. This article considers a number of such issues which have recently arisen, and the way in which they have been dealt with by the Community Courts. |
