A landmark test case brought by Unilever is being referred by a UK High Court judge to the European Court of Justice for guidance. Unilever wants to register the shape of its ice-cream dessert known as Viennetta. However Mr Justice Jacob indicated he was inclined to refuse an application to register the shape of the dessert but would refer the case to the European Court of Justice. |
