The European Court of Justice ruled on 12 November 2002 in favour of Arsenal Football Club in a case brought by the club against a street trader selling scarves marked with the word 'Arsenal'. The Court ruled that the proprietor of a trade mark must be able to prevent its use by a third party if that use is liable to affect the guarantee of origin of the goods.
