Abstract: This book is the first in a new series published by Oxford University Press which deals with subjects of international economic law. The books, which will either be solo-authored or created by teamwork, will seek to address the risks and dangers of the 'globalised' and interdependent world. This publication is devoted to a subject - regulatory competition - which is frequently a central theme in governments' responses to the many problems of 'globalisation' facing policy makers and government officials at all levels. Following an introduction which provides some background to the concepts of globalisation and economic interdependence and discusses moves to and away from the harmonisation of regulation, the book is divided into four parts. The first part provides an introduction to regulatory competition theory. The following three parts examine the regulatory competition theory by region. Part two focuses on the United States system with chapters on multijurisdictional tax competition, federalism and takeover law, regulatory competition in banking and financial services, labour and environmental federalism in the United States. Regulatory competition in the European Union is discussed in part three. In order for a comparison to be made with the United States, the same areas of competition law are analysed, although these are discussed in relation to harmonisation as opposed to federalism. The final part looks at regulatory competition from a global perspective. Labour and environmental regulation are once again recurrent themes but there is also discussion of international securities regulation, antitrust law and the TRIPS agreement . Students and practitioners of regulation will benefit from using this book. Daniel C. Esty is Associate Dean of the Yale School of Forestry and Environmental Studies and Clinical Professor of Law at Yale Law School. Damien Geradin is Associate Professor of Law at the University of Liege and Professor of Law at the College of Europe, Bruges. |
