The WWF has written a letter to the Swedish EU Presidency, August 2009, stating its view that the provision in paragraph 1 of Article 10 in the proposed new Industrial Emissions (IPPC) Directive is incompatible with Article 176 of the Treaty establishing the European Community. As such, the provision if adopted would be invalid and so cannot be adopted in its current form.
