Summary: This anti-dumping methodology identifes and redresses cases where prices of imported products are artificially lowered due to state intervention. It removes the former distinction between market and non-market economies for calculating dumping while maintaining a certain level of protection for producers. Further information: The proposal on a new calculation methodology was put forward by the European Commission on 9 November 2016, following a call from the European Council for an agreement on a comprehensive modernisation of all trade defence instruments (TDIs) and a Communication from the Commission urging Member States to agree on this matters. The text was also a result of orientation debates held in January 2016 and July 2016, as well as the input provided by a public consultation and different stakeholders. The Council of the European Union agreed on its negotiating position on 11 May 2017. The European Parliament adopted its own proposed amendments on 20 June. An informal agreement between the institutions was reached on 3 October. The Parliament formally endorsed the deal in November, while the Council adopted the compromise text on 4 December. The proposed amendments are complementary to those foreseen by the 2013 proposal for a modernisation of the EU's trade defence instruments (TDIs). The proposed AD amendments are linked with the expiry on 11 December 2016 of certain provisions in China’s 2001 WTO Accession Protocol. |
