Directive 2006/1/EC provides for a minimum level of market opening for the use of hired goods vehicles in the European Union's single market. However, the Directive also allows EU Member States to restrict the use of hired goods vehicles with a gross vehicle weight above six tonnes for own account operations. It also allows restricting the use of a vehicle which has been hired in a Member State different from the one where the undertaking hiring the vehicle is established.

The REFIT assessment carried out on the Directive showed that such restrictions have limited its effectiveness. Moreover, they created a burden on undertakings and a patchwork of rules which has created confusion among operators. The draft law proposed to remove the possibility to restrict the use of hired vehicles for own account operations. The use of a vehicle hired in another Member State would become possible for at least four months to enable undertakings to meet temporary or seasonal demand peaks and/or to replace defective or damaged vehicles.

The proposed Directive was tabled by the European Commission on 31 May 2017 as part of its Europe on the Move legislative package. The European Parliament adopted its negotiating position in January 2019. The Council of the European Union adopted its general approach on 3 June 2021. An informal agreement between the co-legislators on a compromise text for this file was reached on 26 October. This was formally adopted by the Council on 20 December, followed by the Parliament in on 5 April 2022. The Act was signed by the co-legislators on 6 April 2022 and published in the Official Journal on 16 May 2022.
