Summary: On 25 May 2016 the European Commission presented a proposal to update Directive 2010/13/EU (the Audiovisual Media Services Directive), reflecting its new approach towards online platforms such as online marketplaces, search engines, payment systems, social media, video and content-sharing sites. The European Parliament's plenary session and the Council of the European Union both adopted their positions on this draft law in May 2017. A preliminary political agreement on the main elements of the revised rules was reached in April 2018, and the new Directive was adopted on 14 November. Further information: The Digital Single Market (DSM) strategy calls for a modernisation of the Audiovisual Media Services Directive (AVMSD) to reflect market, consumption and technological changes. It requires the Commission to focus on the scope of application of the AVMSD and on the nature of the rules applicable to all market players (in particular those for the promotion of European works), the protection of minors and advertising rules. Pursuant to this commitment and in line with 'Better Regulation' requirements (REFIT), the Commission carried out an ex post evaluation. It assessed the effectiveness, efficiency, relevance, coherence and EU added-value of the AVMSD, and pinpointed areas where there was potential for simplification, without undermining the objectives of the AVMSD. This review was presented alongside a package of proposals regarding the e-commerce sector in the European Union, in the framework of the DSM strategy.
