Press Release: Opinion of the Advocate General in the case ECJ C-362/14 Maximillian Schrems v Data Protection Commissioner

In an Opinion issued on the 23 September 2015, Advocate General Yves Bot, said that the European Commission decision finding that the protection of personal data in the United States was adequate did not prevent national authorities from suspending the transfer of the data of European Facebook subscribers to servers located in the United States. The Advocate General considered furthermore that the Commission decision was invalid.

The final judgment from the judges of the European Court of Justice would follow in a few months.

The US Mission to the EU responded in a statement on the 28 September 2015 saying that 'the Advocate General's opinion rests on numerous inaccurate assertions about intelligence practices of the United States'.
