The European Data Protection Supervisor (EDPS) published on 25 September an Opinion regarding the draft proposal on the use of Passenger Name Records (PNR) for the prevention, detection, investigation and prosecution of terrorist offences and serious crime.

Mr Giovanni Buttarelli questioned the 'necessity of collecting and storing excessive amounts of personal information of all passengers in the EU'. The EDPS encouraged the legislators to 'further explore if targeting resources and efforts on known suspects would be more effective than profiling all travellers'.

Mr Buttarelli also recalled a ruling of the European Court of Justice from 2014 which struck down the Data Retention Directive 'because of the general and indiscriminate collection of the data of the population'.

The EU PNR was proposed by the European Commission in 2011 but got stuck in the European Parliament's civil liberties committe until it eventually approved the draft law in July 2015 following the Charlie Hebdo attack in Paris earlier in the year. Trilogue negotiations were taking place by the time this Opinion was released.
