French gay marriage ban ‘not unconstitutional’

France’s ban on same sex marriage does not violate the constitution and the decision on whether to legalise it rests with parliament, according to the country’s Constitutional Council in a judgement issued on the 28 January 2011.

In batting the question away to parliament, the court left open the way for it to legalise same sex marriage.
