On the 22 July 2016, the European Commission referred the Czech Republic to the Court of Justice of the EU for its failure to take back hazardous waste, which had been shipped to Poland, by a Czech operator in late 2010 and in early 2011.

Because the case forms a part of a dispute between the Czech Republic and Poland on the classification of a waste shipment, the European Commission had stepped in to resolve the dispute and had sent a reasoned opinion to the Czech Republic in November 2015. However, the Czech authorities had refused to take the waste back.
